Terms and Conditions for Intermediation Services in the Purchase of Goods (Dropshipping)
1. General Provisions
- These Terms and Conditions define the rules for the provision of intermediation services in the purchase of goods by the entrepreneur operating under the name Aivoranshop (hereinafter: the "Intermediary").
- The Intermediary is not the seller of the goods – the Intermediary acts solely as an intermediary who, upon the Client's order, organises the purchase and delivery of the goods from an external supplier.
- By placing an order, the Client commissions the Intermediary to purchase a specific good on their behalf and account.
2. Nature of the Service
- The Intermediary collects remuneration from the Client for the intermediation service (hereinafter: the "Commission").
- The Commission is the sole income of the Intermediary. The price of the goods transferred to the supplier does not constitute the Intermediary's income.
- The Intermediary purchases the goods from an external supplier in accordance with the specifications selected by the Client.
- The Intermediary does not warehouse the goods – the product is shipped directly from the supplier to the Client.
3. Scope of the Intermediary's Liability
- The Intermediary is responsible only for the correct transmission of the order and payment to the supplier.
- The Intermediary is not responsible for:
- the quality, operation, or defects of the purchased goods,
- the time of shipment and delivery,
- damages during transport,
- differences between the description, photos, and the actual product.
- All claims related to the goods, including complaints, shall be addressed by the Client directly to the supplier.
4. Order Placement Process
- The Client places an order on the Intermediary's website, indicating the product, variant, and shipping details.
- The Intermediary collects a payment from the Client comprising:
- the purchase price of the goods,
- the Intermediary's commission.
- Upon receipt of payment, the Intermediary purchases the goods on the Client's behalf.
5. Payments
- The Client makes the payment to the Intermediary, who then transfers the appropriate part to the supplier.
- The Intermediary's commission is a non-refundable amount, unless the purchase cannot be executed.
6. Complaints and Returns
- The Intermediary supports the Client in contacting the supplier but is not responsible for the outcome of the complaint.
- Any returns shall be carried out in accordance with the rules defined by the supplier.
- The Intermediary does not conduct its own product complaint procedure.
7. Personal Data
- The Intermediary processes the Client's personal data solely for the purpose of providing the service.
- The Client's data may be transferred to the supplier for the purpose of delivering the goods.
8. Taxes and Accounting – Rules for the Intermediary
- The Intermediary's income is solely the commission collected from the Client.
- Amounts transferred to the supplier for the purchase of goods do not constitute the Intermediary's income or cost.
- The Intermediary keeps revenue records in accordance with the lump-sum tax law (3% rate).
- The document confirming the income is an accounting voucher stating the amount of the commission.
9. Final Provisions
- By accepting the Terms and Conditions, the Client confirms understanding the intermediation model and the fact that the Intermediary is not the seller of the goods.
- The Intermediary reserves the right to amend these Terms and Conditions.
- The Terms and Conditions are valid from the moment of their publication on the website.
